TERMS AND CONDITIONS for use of the e-lektor.eu platform and privacy policy.

By registering on the e-lektor.eu platform and using its sources you accept the following terms and conditions and privacy policy.

§1 Definitions

For the purposes of these Terms and Conditions, the following meanings shall be understood:

1. Platform – e-learning system on the e-lektor.eu website – containing educational content, belonging to LEKTOR Travel sp. z o.o. ul. Oławska 25, 50-123 Wrocław Tax ID number: 8971804449
2. Course – an online language course, sold by the Service Provider.
3. User – a natural or legal person, buying access to course
4. User account – a set of resources and rights within the Platform assigned to the User
5. Service Provider – LEKTOR Travel sp. z o.o. ul. Oławska 25, 50-123 Wrocław, Tax ID number: 8971804449
6. Shop – online store available at the address e-lektor.eu/shop
7. Payment operator – the subject matter responsible for payments service.

§ 2

The Terms and Conditions contain rules governing the rights and obligations of the Service Provider (LEKTOR Travel sp. z o.o. ul Oławska 25, 50-123 Wrocław, Tax ID number: 8971804449) and the User (a natural or legal person, buying the Course).

§3 Purchase of the course and use of the Platform

1. The Service Provider via the Store sells the User access to the Course 7 days a week, 24 hours a day. Information about any service interruptions will be available on the Platform’s website.

2. The conclusion of the contract for the Purchase of the Course is possible only after creating a free User account. The user is obliged to enter personal data in accordance with the facts. The User’s login and password cannot be offensive, proper words, trade names, or words affecting the rights of third parties. In the event of violating this conditions, the account can be deleted by the Service Provider, and payments made by the User shall be returned.

3. After clicking „Go to the checkout” button in the Store, the User will be transferred to the Payment operator’s website in order to make the payment for the chosen Courses. After successful payment, the User will be transferred to the Website with the purchase confirmation. With this moment, the contract for the purchase of the Course is considered to be concluded.
4. The Service Provider enables the purchase of the Course on the basis of the pre-payment for a given period of time or in a form of monthly subscription, renewable upon the consent of User.
5. In the event of purchasing the Course in the form of a monthly subscription, the User in the moment of purchase agrees to charging his account periodically with the course fee by Service Provider. The User may cancel the subscription at any time by sending the termination to the following e-mail address: info@e-lektor.eu
6. The user may test full access to a given Course for a period of 10 days by registering on the Platform and purchasing the access to the Course at a preferential price. After the expiry of that period the User automatically agrees for a monthly subscription, see point 5.

7. The User, in order to receive a VAT invoice for the purchase of access to the Course, should inform the Service Provider by e-mail to the address info@e-lektor.eu within 7 days from the day of making the payment.
8. The Service Provider informs about the possibility of short interruptions in access to the Platform resulting from maintenance and technical works. If the interruptions in access to the Platform will exceed 10 hours within one month, the User is entitled to extend the access to the Platform for a period equal to the interruption in the access to the Platform. The condition for receiving an extension of access to the Platform is reporting this fact to info@e-lektor.eu within 21 days from the month when the Platform was unavailable.

§4 Delivery of purchased Course

1.The delivery of the purchased course will take place immediately after making the payment by the User, not later than within 24 hours from the moment of receiving the payment by The Service Provider. The Course will be available in the User Panel after entering e-lektor.eu website. The User will also receive notification about the availability of the purchased Course to the e-mail address given in the moment of creating the account.

§5 Copyright

1. Educational resources of e-lektor.eu Platform are the work within the meaning of the statute of copyrights and all copyrights shall be vested to the Service Provider.
2. The Service Provider excludes the possibility of copying, reproduction, modification, distribution or other forms of any commercial exploitation of materials owned by the Service Provider, i.e. texts, dialogues, recordings, movies.

§6 Withdrawal from the contract

In accordance with art. 27 of the Act of 30 May 2014 on consumer rights, the User has a right of withdrawal from the Purchase contract of the Course without giving reasons within 14 days from the moment of concluding the Contract. The User may submit the notice of withdrawal by sending an e-mail to info@e-lektor.eu

§7 Complaints and irregularities

1. Information on irregularities and complaints submitted by the User should include:  Name and surname
E-mail or login of the User submitting complaint

The reason for the complaint with the accurate description and justification
Signature of the User and date of the complaint.

2. All complaints shall be considered within 14 working days from the day of receiving them. The complaints should be send by e-mail to info@e-lektor.eu or by post to the following address LEKTOR TRAVEL SP Z O O, Ul. Oławska 25, 50-123 Wrocław.
3. Contact with the Service Provider is possible at the following e-mail address: info@e-lektor.eu

§8 Privacy Policy

1. Privacy Policy shall inform Users what personal data are collected from the data subject, for what purpose and how they will be used. All Platform Users accept its privacy policy. During the User’s visit on the Platform, data related to user’s IP, address and browser are automatically collected.

2. As a result of registration and/or use of the Platform, with enabled support for cookies, the User agrees to the use of cookies files mechanism, i.e. storing these files on the User’s device memory.

§9 Personal data

1. Giving personal data of a User is necessary in order to provide the service.  Data submission is voluntary, but it is necessary for the proper implementation of the service. The administrator of the personal data is the Service Provider. The data is processed only in accordance with the following purposes.
Name and surname  – as the basic identification of the User

Contact e-mail – for the purpose of sending the information about access to the Course, in organisational matters and further proposal related to learning a foreign language, in order to motivate the User to learn

Address of residence – in order to issue an invoice for the service
2. Providing this data is mandatory in accordance with the applicable regulations in order to provide the service.
Due to processing of personal data each person has the following rights:
the right to request access to their personal data, rectification, erasure and restriction of processing, the right to object to the processing of data, the right to data portability, the right to withdraw consent to the processing personal data for a certain purpose, if previously such a consent was given, the right to lodge a complaint with a supervisory authority on issues related to processing of personal data.
3. The above rights may be exercised in accordance with the principles described in art. 16 – 21  RODO [General Data Protection Regulation] by contacting at the following e-mail address: info@e-lektor.eu
We guarantee confidentiality of all personal data transferred. We ensure that all security measures and personal data protection required by provisions on the protection of personal data will be taken. Personal data is collected with due diligence and it is protected from unauthorized access. The Service Provider entrusts the processing of personal data only to authorized entities.
4. The User’s personal data will be processed for the period of using the service and for the duration of  the contract or until the withdraw consent for their processing.

§10 Final provisions

1. These Terms and Conditions are referred to in art. 8 of the Law on Provision of Electronic Services and are available at: e-lektor.eu/regulamin.
2. The Terms and Conditions may be amended at any time, without the need to justify the reason, e.g. due to important legal, technical or organisational reasons.
3. Using the Platform by the User after the entry into force of the amendments to the Terms and Conditions is tantamount to acceptance of the changes made by the User.
4. Any disputes arising from the provision of services by the Service Provider on the Platform will be settled amicably or will be resolved by the competent local court and court of law for the Service Provider.
5. Matters not regulated herein shall be governed by generally applicable provisions.
